The Privacy Policy has been published and entered into force:May 29th, 2021

Please read this document carefully to understand our position and policy regarding your Personal Data and how we will use it.

This Architect Studio Privacy Policy (hereinafter referred to as the “Privacy Policy”) describes our policy regarding the confidentiality of Personal Data processed by the Company during the provision of the Services.

References to the words “we”, “our” or “us” (or similar words within the meaning) mean the “Architect Studio” Company.

References to the words “you”, “you” or “your” (or similar words within the meaning) mean our User. That is, an individual, Personal Data that we collect, use and process.

The Privacy Policy describes the types of Personal Data that we collect, store and process on the Company’s server.

The Privacy Policy applies only to Personal Data collected by the Company during the provision of the Services to the User.

This Privacy Policy does not apply to Personal Data collected offline or through channels other than this Company.

Architect Studio is committed to making every effort to protect the privacy of your Personal Data. Architect Studio uses the Personal Data collected about you to fulfill its contractual obligations and improve customer service.

We are grateful for your use of the Architect Studio Services.

1. DEFINITIONS

1.1. Affiliate – means a legal entity that belongs to the Owner and through which Architect Studio provides Services to the User.

1.2. “Architect Studio” company (hereinafter “Company” or “Architect Studio”) – means a legal entity that provides Services to the User for the development and implementation of the Project.

1.3. Checkbox – means an element of the User’s graphical interface that allows the User to confirm his Consent. For example: when expressing Consent to the processing of Personal Data.

1.4. Company’s website (hereinafter referred to as the “Site”) means a web page or a group of web pages on the Internet, through which the User receives the Services and uses the services of the Company, which are posted on the Internet at the following address: https://architectstudio.net/ 

1.5. Cookie – means files that store information about your previous actions on the Site. For example: date and time of site visit, clicks and transitions.

1.6. Owner of the Company “Architect Studio” – means Architectstudio, LLC, a legal entity incorporated under the laws of the United States of America, Delaware, located at 16192 Coastal Highway Lewes, DE 19958, represented by CEO Mkrtchyan Gevorg (hereinafter referred to as the “Owner”).

1.7. Personal Data – means any information that directly or indirectly allows you to identify the User. For example: name, surname, phone number, passport data.

1.8. Project – means a unique set of processes, limited in time, resources and quality requirements, aimed at creating a construction object.

1.9. Services – means the tools and materials developed and provided by Architect Studio for the development, implementation and execution of  Project for the construction of a residential or non-residential building. You can familiarize yourself with the types of provided Services in more detail in the Terms of Use.

1.10. Terms of Use – means a document that provides terms, rules and basic provisions for the provision of Services by the Company.

1.11. Third Party – means a natural or legal person, public authority, institution or body other than the data subject and/or the Company.

1.12. User – means an individual and/or legal entity that interacts with the Company to receive the Services from it.

1.13. User’s consent (hereinafter “Consent”) – means a voluntary, specific, informed and unambiguous expression of will, in which the User, by means of a statement or a clear affirmative action, consents to the processing of his Personal Data.

Terms and concepts that are not defined in the Privacy Policy are specified in the Terms of Use. You may familiarize yourself with the Services and the rules of the Company by studying the Terms of Use.

2. GENERAL PROVISION

2.1. The Privacy Policy applies to the Personal Data that the User provides to the Company while receiving the Services.

2.2. The Privacy Policy describes the rules for the processing, presentation, storage and protection of the User’s Personal Data received by the Company during the provision of the Services to the User.

2.3. Architect Studio has the right to periodically conduct audits to improve the security of Personal Data and avoid losing it.

2.4. An audit can be carried out in the following cases:

2.4.1. At the beginning and at the end of the reorganization of the Company’s activities;

2.4.2. Schedule, every 6-12 months;

2.4.3. Before conducting risky transactions with Personal Data;

2.4.4. After revealing the fact of violation of the security of Personal Data.

2.5. The Company has the right to conduct the following types of audit:

2.5.1. Internal audit. Carried out by the Company independently;

2.5.2. Authorized audit. Carried out by regulatory authorities authorized to conduct investigations and inspections for the proper processing of Personal Data by the Company;

2.5.3. External audit. It is carried out by an independent expert in the protection of Personal Data, who can be engaged by the Company to carry out an audit.

2.6. Architect Studio is not responsible for the activities of other companies that are not owned, operated or controlled by it.

3. JUVENILE POLICY

3.1. The Company’s Services are intended for persons who have reached the age of eighteen.

3.2. The Company does not knowingly collect or process Personal Data from persons under the age of eighteen.

3.3. If you have not reached the age of eighteen, do not use the Company’s Services.

3.4. In the event that we become aware of the receipt of the Services by such a person, we will delete the collected information about this person.

4. PERSONAL DATA

4.1. We distinguish the following categories of Personal Data:

4.1.1. Sensitive Data – means data, unauthorized disclosure, modification or concealment of which could lead to tangible loss. For example: race, religious and political beliefs, income information, gender – anything that, if disclosed, could violate privacy and cause moral damage to an individual.

4.1.2. Statistics – means information that rarely changes over time or cannot be changed. For example: phone number, email, IP, passport data, Cookie.

4.2. Personal Data that you provide to us may include your (-s; -and; -y):

4.2.1. name and surname;

4.2.2. IP;

4.2.3. photos or video materials that you can transfer to us for the implementation of the Project;

4.2.4. residence address and citizenship;

4.2.5. marital status;

4.2.6. information about your relatives, including but not limited to: financial situation, tax residency, telephone number and e-mail address;

4.2.7. passport data;

4.2.8. tax residency;

4.2.9. phone number and email address;

4.2.10. bank details, including account numbers and payment details;

4.2.11. date and place of birth;

4.2.12. sources and amounts of income;

4.2.13. information about the location of the site on which the building will be constructed.

4.3. Users voluntarily provide us with Personal Data using the Company’s Services, consulting with employees, sending us email messages, or cooperating with us in any other way.

4.4. You can provide us with Personal Data about yourself and/or the Project by filling out the appropriate forms on the Company’s Site or by providing such information to us by phone, email or in any other way.

4.5. During your interaction with the Company, we automatically receive and record Personal Data about your actions. For example: the history of the pages viewed, the time and date of the visit, the browser used.

4.6. The collection of Personal Data is carried out using log files, Cookies and other tracking technologies.

4.7. The Company may use Personal Data in order, based on your preferences, to improve the navigation of the Site and the Services it provides.

4.8. Architect Studio does not collect or process sensitive User Personal Data such as ethnicity, political opinions, religious or philosophical beliefs, union membership, genetic or biometric data, health, sex life or sexual orientation information.

4.9. Every time you visit the Site, we may collect about you (including automatically), for example, the following information:

4.9.1. technical information, including the Internet Protocol (IP) address used to connect your computer to the Internet;

4.9.2. data about your visit to the Site, including full information about the unified resource locator (URL), the route of transitions to the Site and when switching to / leaving the Site (including date and time), page response time, data loading errors, duration of stay on certain pages, activity on the page (information such as scrolling and mouse movements, clicks), the methods used to exit the page, and the phone numbers that were used to contact the customer support center;

4.9.3. geolocation information, we may use this information to optimize our Services.

4.10. If the User is a resident of one of the countries of the European Economic Area (EEA), then his Personal Data is processed, stored and transmitted on the basis of the General Data Protection Regulation, based on:

4.10.1. Consent on behalf of the User;

4.10.2. the concluded agreement on the processing of personal data;

4.11. The Company does not support Do Not Track (“DNT”) under the California Internet Protection Act (CalOPPA). 5. PURPOSES OF USE OF PERSONAL DATA

5.1. We will use your Personal Data for the following purposes:

5.1.1. to fulfill the obligations stipulated by any agreements concluded with you, as well as to provide you with the information you requested;

5.1.2. for the efficient provision of the Services;

5.1.3. during the creation of the Project;

5.1.4. to ensure the security of our Site;

5.1.5. to administer our Site and conduct internal operations, including troubleshooting, data analysis, testing, statistics collection and for conducting surveys;

5.1.6. to provide support, respond and resolve your complaints and the capabilities of our Site;

5.1.7. to improve our Site and to make sure that our content is as convenient as possible for your computer’s operating system;

5.1.8. to ensure the most efficient presentation of the content of our Site and its use from your computer;

5.1.9. for internal business and research purposes, such as communicating with you;

5.1.10. to respond to inquiries from law enforcement agencies;

5.1.11. to initiate and respond to legal claims;

5.1.12. to investigate or resolve disputes with you;

5.1.13. to verify and verify the identity of the Users;

5.1.14. to notify our Users, for example, in case of changes in the policies and rules of the Company.

6. DISCLOSURE OF PERSONAL DATA

6.1. We have the right to disclose Personal Data in the following cases:

6.1.1. Third Parties. (in case of change of control). The Owner has the right to sell, disclose or transfer information about Users, as part of a corporate business transaction such as an acquisition or merger, financing, corporate reorganization, joint venture, including the sale of company assets, or in the event of bankruptcy or insolvency, in which such information may be disclosed to any Third Parties as a business asset in a transaction. For example, in the event of a merger of the Company with another similar service, your Personal Data may be transferred to such a service.

6.1.2. Courts, law enforcement and government agencies. The Owner has the right to transfer Personal Data in case of fulfillment of any legal obligations (including in connection with a court order). For example: A court order, a request from government and /or law enforcement agencies.

6.1.3. Affiliates. The Owner may disclose the User’s Personal Data during the processing of Personal Data and the provision of Services to the User.

7. USER RIGHTS

7.1. The right to access. The Privacy Policy lists the User’s Personal Data. The User may contact us directly to request access to the Personal Data we hold about him.

7.2. The right to be forgotten. The User has the right to delete Personal Data about himself The User’s Personal Data, in this case, will be deleted forever.

7.3. Right to rectification. The User has access to Personal Data that needs to be updated, corrected, supplemented at any time. The User may also contact Architect Studio to access their Personal Data in order to correct, change or delete it.

7.4. Right to data portability. The User has the right to receive a copy of his Personal Data, which is stored by the Company, in a structured, machine-readable and widely used format.

7.5. Right to object. The User has the right to object to the processing of Personal Data at any time.

7.6. Right to withdraw Consent. The User has the right to withdraw his Consent to the processing of Personal Data at any time, in which case the Company has the right to stop providing him with the Services.

7.7. To exercise the User’s rights provided for clauses 7.1., 7.2., 7.3., 7.4., 7.5., 7.6 .. The User can contact the email address: contact@architectstudio.us.

7.8. The User has the right to submit a complaint to the email address: contact@architectstudio.us if he believes that his rights to process Personal Data have been violated.

7.9. The complaint must contain:

7.9.1. a description of the reason for the complaint;

7.9.2. a description of the essence of the complaint;

7.9.3. a description of the rights that have been violated;

7.9.4. contact details of the person who filed the complaint;

7.9.5. e-mail of the contact person.

7.10. The Company may ask the User to confirm his identity before responding to his request to exercise the rights provided for in clauses 7.1., 7.2., 7.3., 7.4., 7.5., 7.6.

7.11. At the request of the User, we provide information about the fact of the processing of Personal Data by a Third Party.

7.9.12. Architect Studio provides a response to the complaint to the e-mail of the User’s contact person within 30 (thirty) business days from the date of receipt of such a complaint.

7.9.13. Architect Studio has the right not to provide a response to a complaint if it does not contain one of the conditions specified in clause 7.9. of this Privacy Policy.

7.9.14. If the User believes that during the processing of Personal Data his rights were violated or he is concerned about the methods and methods of processing Personal Data by Architect Studio, then he has the right to file a complaint with the Data protection supervisory authority.

7.9.15. The User, depending on the circumstances, submits a complaint to the supervisory authority at the place of his registration, location, employment or to the supervisory authority of the country in which he is a resident.

7.9.16. If the User is a resident of one of the countries of the European Economic Area, then he can file a complaint with the appropriate supervisory authority for the list.

8. STORAGE OF PERSONAL DATA

8.1. Personal Data stored on the Company’s server is tied to the User’s name.

8.2. We use security measures to ensure the confidentiality of your Personal Data and to protect it from loss, misuse, alteration or destruction. Only authorized Architect Studio personnel have access to your Personal Data, and these employees are required to treat Users’ Personal Data as confidential. The existing security measures will be reviewed from time to time in accordance with new legislation and technical innovations.

8.3. The Personal Data we collect from you may be transferred and stored outside the European Economic Area (“EEA”) and/or outside the United States of America (“USA”) for the purpose of providing you with our Services.

8.4. By providing us with your Personal Data, you Consent to the transfer, storage and processing of Personal Data. In turn, we will take all necessary measures to ensure that your Personal Data is processed in compliance with the security rules and in accordance with the provisions of this Privacy Policy.

8.5. The User’s personal data can be stored by the Company until the request is received, on behalf of the User for their deletion, or for 5 (five) years, if such storage is necessary to record statistical data.

8.6. We retain Personal Data for as long as is necessary to provide the Services or comply with our legal obligations, resolve disputes, prevent misuse, and enforce our agreements.

8.7. Personal Data stored on the Company’s server is considered the property of the User.

8.8. We have the right to use and disclose User Personal Data only for the purposes specified in the sections of the Privacy Policy and Terms of Use.

8.9. In the event of a change in Personal Data, the User is responsible for notifying the Company of such changes. For example: The User has changed Personal Data (e-mail, phone number, address), information that is necessary for the correct provision of Services and did not notify Architect Studio about this fact.

9. PROTECTION OF PERSONAL INFORMATION

9.1. We take all reasonable and appropriate measures to protect Personal Data from loss, misuse and unauthorized access and disclosure, modification and deletion, taking into account the risks associated with the processing and the specifics of Personal Data.

9.2. Although the laws on the protection of the rights and privacy of Personal Data may differ from those in your country, we do our best to provide adequate measures to protect your Personal Data.

9.3. We may use the following methods to protect Personal Data:

9.3.1. pseudo-anonymization and encryption of Personal Data;

9.3.2. the ability to ensure the continued confidentiality, integrity, availability and resilience of processing systems and Services;

9.3.3. regular testing, assessment and measurement of the effectiveness of technical and organizational measures to ensure the security of the processing of Personal Data.

9.3.4. By checking the empty Checkbox you agree to the rules for the collection, storage, processing and transfer of your Personal Data to Third Parties to whom we may transfer information in accordance with the provisions of the Privacy Policy.

10. BASIS FOR PROCESSING PERSONAL DATA

10.1. We collect and process your Personal Data only when we have a legal basis for such processing.

10.2. Legal bases include:

10.2.1. User Consent (in cases where you give it);

10.2.2. Contract (in cases where processing is necessary to fulfill the terms of agreements between you and Architect Studio);

10.2.3. Fulfillment of obligations required by law (in cases where Architect Studio is obliged to request/receive and process and store your Personal Data in order to comply with the requirements of applicable law, for example, legislation related to legalization (laundering) of proceeds from crime and financing of terrorism, in accordance with a legitimate interest ( for example, in cases where processing is necessary to protect you or us from certain threats: fraud, security threats, etc.);

10.2.4. To comply with the provisions of applicable law, for the proper level of our business, the conclusion and execution of corporate transactions (sale of shares, mergers, acquisitions).

10.3. In cases where the basis for the processing of Personal Data is your Consent, you have the right to withdraw it at any time.

11. DISCLAIMERS

11.1. Architect Studio uses Cookies to improve the quality of our service. If you continue to receive the Company’s Services, then we have the right to assume that you agree to the use of Cookies.

11.2. Architect Studio notifies the User that his Personal Data can be used to provide the Services, and in case of disagreement, the User must terminate the relationship with the Company.

11.3. Unfortunately, the transmission of information via the Internet cannot be completely secure. While we make every effort to protect your Personal Data, we cannot guarantee a secure transfer of Personal Data. In this regard, you are solely responsible for possible failures in the transfer of Personal Data to us. Upon receipt of Personal Data, we undertake to follow strict procedures and all necessary technical and security measures to prevent unauthorized access to your Personal Data.

12. CHANGES TO PRIVACY POLICY

12.1. We have the right to periodically make changes to this Privacy Policy to ensure the safety of Personal Data and to comply with the requirements of US law.

12.2. We notify the User of such changes by posting news on the Site, sending an e-mail newsletter, or using other means.

12.3. In the event that the User has unsubscribed from emails in which we inform about all changes in the legal documentation, the User is still responsible for familiarizing with them.

12.4. Architect Studio, after making changes to the Privacy Policy, has the right to request the User’s repeated Consent to the Privacy Policy if the User has refused the information e-mail newsletter.

12.5. Our electronic or otherwise stored copies of the Privacy Policy are deemed to be genuine, complete, valid and enforceable versions of this Privacy Policy in effect at the time of your visit to the Site.
